These calls can drive anyone crazy!
They start first thing in the morning and can last until late in the evening. The callers often say the same things over and over again: “When can you send money?” “Why don’t you sell this or do that?” Or even more threatening: “If you don’t send money by ___, this will be turned over to, or papers will go through, etc., etc.” Not just that, but the “tactic” they often use is to have someone from the same company call you – multiple times a day – and “act” like they don’t know someone has already called you about the account.
Under the FDCPA (the Fair Debt Collection Practices Act), a Federal Law passed in 1977, there are many things collectors are not supposed to do in these phone calls (discuss your debt with your coworkers or neighbors; use intimidation, false threats of arrest, or legal action; use profanity, or represent themselves as an attorney). In my experience, unfortunately, they break many of the rules anyway.
One rule that debt collectors DO seem to listen to is that when you simply tell them to call your attorney, they are not allowed to call you anymore! Not only does it mean they can no longer talk to you, but they know you have someone who may sue them for breaking the rules.
One of the first things I do when you hire me, even for a very small initial payment, is to start accepting those creditor calls for you. When I tell clients to pick up the phone, and say “please call my attorney,” they get such a look of relief on their faces. Yes, and it’s really that simple.
